Terms and Conditions

The Educators Well is operated by Rachel Smith, ABN 59 334 787 286, trading as The Educators Well. In these Terms, The Educators Well may also be referred to as “we”, “us” and “our”.
These Terms apply when you use this website or purchase anything from us. Please read them before you enrol, book or subscribe. If something is unclear, contact us and we will explain it before you go ahead.
1. Who these Terms apply to
These Terms apply to everyone who uses the website at educatorswell.com.au, creates an account, purchases a programme or resource, holds a membership, books training or attends an event we run.
Where you purchase on behalf of an early childhood service, workplace or organisation, you confirm you are authorised to accept these Terms for that organisation, and these Terms apply to that organisation as well as to you.
Some purchases have extra terms that are shown to you at the time, for example the payment-plan terms in section 5 or the terms of a partner offer. Where extra terms apply to a specific purchase, they apply in addition to these Terms.
2. What we offer
The Educators Well provides professional learning, resources and support for educators and education and care services. Depending on what you choose, that may include:
- The WELL Framework, our self-paced professional learning programme.
- Educator Membership for individual educators.
- Service Membership for early childhood services and organisations.
- Professional development, learning resources and downloadable materials.
- Webinars and other online learning.
- Bookings, sessions and events.
- First Aid 2 U training and enrolments.
- Member benefits and promotional or partner offers.
What is included in each purchase is described on the page for that product or service at the time you buy it. That description forms part of these Terms.
3. Purchases and enrolments
Your purchase is complete when we confirm it, which usually happens once your payment, or the first instalment of a payment plan, has been successfully processed.
You agree to give accurate details when you purchase or enrol, including a valid email address, because we use it to deliver access, receipts and service notices.
Purchases and enrolments are personal to the individual named, unless the product is expressly sold for a service, team or organisation. Access must not be shared, transferred or resold without our written agreement.
We may decline or cancel a purchase where there has been an obvious pricing or listing error, where a payment cannot be verified, or where these Terms have been breached. If we do, we will contact you and refund anything you have paid for the cancelled purchase.
4. Pricing and GST
Prices are shown in Australian dollars. Where a price is shown excluding GST, it is labelled “+ GST” and GST is added at checkout. Where a price is shown as including GST, or as GST free, it is labelled that way. Your receipt or tax invoice shows the GST treatment that applied to your purchase.
Prices can change from time to time. A change never affects a purchase you have already completed, and it does not change the instalment amount or total payable under a payment plan you have already started.
Where a promotional, partnership or campaign price applies, the conditions of that offer are displayed with the offer.
5. Payments
Payments are processed by our payment provider. We do not receive or store your full card details. By paying, you confirm you are authorised to use the payment method you provide.
5.1 Payment options
The WELL Framework may be purchased by paying in full or, where offered, through a fixed-term payment plan.
The standard 12-week payment plan consists of 12 weekly instalments. It is a fixed payment commitment for the purchase of The WELL Framework. It is not a cancel-anytime subscription or an ongoing membership.
5.2 Price
The current standard pricing for The WELL Framework is:
- Pay in full: $897 + GST.
- 12-week payment plan: 12 weekly instalments of $79 + GST, for a total payment-plan price of $948 + GST.
Where a promotional, partnership or campaign offer has different pricing, the applicable instalment amount, number of instalments and total payable will be clearly displayed before purchase.
5.3 Automatic payments
By selecting a payment plan and completing enrolment, you authorise our payment provider to automatically charge the nominated payment method for the agreed instalments according to the payment schedule displayed at checkout.
The first instalment is collected at enrolment. For the standard 12-week payment plan, subsequent instalments are collected weekly and automatic collection ends after the twelfth instalment.
5.4 Access under a payment plan
Access to The WELL Framework begins after the first successful payment.
The included Educator Membership is provided as part of the Framework enrolment for the applicable access period.
Choosing a payment plan does not reduce the Framework access period compared with paying in full.
5.5 Unsuccessful and overdue payments
If an instalment cannot be collected, our payment provider may automatically retry the payment.
Access will not ordinarily be suspended immediately following a single unsuccessful payment.
If a payment remains outstanding, we may contact you regarding the overdue payment and may temporarily suspend access to The WELL Framework and the included Educator Membership until the outstanding payment is resolved.
Our current payment recovery process provides an initial period for payment retries and review before access is suspended.
Suspension of access because of an overdue instalment does not, by itself, cancel the payment plan or the remaining amount payable.
Where an overdue payment is successfully recovered, access may be restored.
5.6 Completing the Framework before your payment plan ends
Completing some or all of The WELL Framework before your final scheduled instalment does not end the payment plan.
Unless a refund, cancellation or other remedy applies under these Terms, our Refund Policy or Australian Consumer Law, the remaining agreed instalments continue to be payable.
5.7 Payment details
You are responsible for ensuring that a valid payment method is available for scheduled instalments.
If your payment details need to be updated, please follow the payment-provider instructions supplied to you or contact The Educators Well for assistance.
6. Access to digital programmes and resources
Where a product has a stated access period, that period is shown on the product page and in your confirmation. The WELL Framework is currently offered with 12 months access.
Access begins once your purchase is confirmed, or after your first successful payment if you are on a payment plan. Access is provided through your account on this website, so please keep your sign-in details current.
Some resources are released progressively or become available as you work through a programme. Where that applies, it is described on the programme page.
We may update, improve or replace the content of a programme or resource during your access period. We will not materially reduce what you have paid for.
7. Memberships and renewals
Membership gives you access to the inclusions described on the membership page for the membership period you purchase. Inclusions may be added to or adjusted over time, and member benefits offered by third parties may change or end.
Where a membership is included with another purchase, such as the Educator Membership included with The WELL Framework, it runs for the period described with that purchase and is part of that purchase rather than a separate ongoing arrangement.
Where a membership renews, the renewal arrangements and how to stop a renewal are shown on the membership page and in your account. Stopping a membership renewal is separate from a Framework payment plan and does not end a payment plan.
Service Membership is held by the service or organisation that purchases it, and the named administrator is responsible for managing who in that service has access.
8. Bookings, training and events
Bookings, webinars, sessions and events are subject to availability and to any details shown at the time of booking, including the date, time, duration, format and who the session is for.
Please arrive or join on time. Where a session has requirements, such as preparation, equipment or a minimum number of participants, those requirements are shown when you book.
Nationally recognised training offered through First Aid 2 U is delivered through our training partnership with Allens Training Pty Ltd RTO 90909. The relevant course page explains the enrolment process and certification arrangements. Where enrolment is completed through an external training provider or platform, any provider-specific enrolment, cancellation or refund terms shown during enrolment also apply. Those terms do not exclude, restrict or modify any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
Other First Aid 2 U products, resources, online learning or services may be offered directly by The Educators Well or through another provider. The relevant page identifies the provider and arrangements that apply. Non-accredited training is labelled as such and does not provide a nationally recognised qualification.
Cancellation, rescheduling and refunds for bookings, training and events are covered by our Refund Policy.
9. Cancellations and refunds
Our Refund Policy forms part of these Terms and explains how cancellations and refunds are handled, including for purchases made through a payment plan.
Stopping, disputing, reversing or failing to make an individual payment does not by itself cancel a payment plan. If you are having difficulty, please contact us so we can look at your situation.
10. Intellectual property and how you may use our resources
All content we provide, including programmes, frameworks, templates, guides, recordings, images and written material, is owned by The Educators Well or used with permission, and is protected by copyright.
When you purchase or access a resource, we give you a personal, non-exclusive, non-transferable licence to use it for your own professional practice, including using printable and practical resources within your own work with children and families.
Unless we agree in writing, you must not:
- share, sell, publish or distribute our resources outside your own practice;
- share your account or access with another person;
- use our material to deliver your own training or professional development to others;
- remove our branding or present our material as your own, or use it for artificial intelligence training or bulk reproduction.
Where a resource is purchased under a Service Membership or for a team, it may be used within that service by its educators, and not beyond it.
Where you contribute content to us, such as to The WELL Collaboration Project, the terms shown with that contribution process apply, including how you are credited.
11. Your account
You are responsible for your account, for keeping your sign-in details secure and for activity that happens under your account. Please tell us promptly if you believe someone else has accessed it.
Please use the website, our community spaces and our events respectfully. We may suspend or end access where an account is shared or misused, where our content is copied or distributed in breach of these Terms, or where behaviour is unlawful, abusive or unsafe for others. Where we do this, we will tell you why, and it does not affect your rights under the Australian Consumer Law.
12. Availability and changes
We aim to keep the website and your access available, but we cannot guarantee it will be uninterrupted. Access may be unavailable at times because of maintenance, updates or matters outside our control.
We may make reasonable changes to our services, content, inclusions and these Terms. If we make a change that materially affects something you have already purchased, we will let you know. Changes to these Terms apply from the date they are published on this page, and do not change the agreed price, instalments or access period of a purchase you have already made.
13. Third-party services
We use trusted third parties to run parts of our service, including payment processing, email delivery, online event hosting, website hosting and course enrolment for some training. Their handling of your information is described in our Privacy Policy.
Some links, member benefits and partner offers take you to businesses we do not control. Their own terms and prices apply, and the goods or services they supply are supplied by them, not by us. We share member benefits and recommendations in good faith and they are not an endorsement or a guarantee of any third party’s goods, services or advice.
14. Professional learning, not professional advice
Our programmes, resources and wellbeing tools are educational and reflective supports for professional practice. They are not medical, psychological, legal or regulatory advice, and they do not diagnose or treat any condition.
You remain responsible for your own practice and for meeting the requirements that apply to your role, service, employer or regulator. If you need personal support, please contact a qualified professional or an appropriate support service.
15. Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy available to you under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
Where we are permitted to do so, and other than for those non-excludable rights, our liability for a failure to comply with a consumer guarantee is limited to resupplying the relevant service or paying the cost of having it resupplied.
These Terms are governed by the laws of Queensland, Australia, and the courts of Queensland have jurisdiction, without limiting any right you have to bring a matter in another forum available to you by law.
